1. Overview

FoundHex Inc. ("FoundHex," "we," "us," or "our") respects the intellectual property rights of others and expects users of the Repaxio platform to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, we will respond to valid notices of alleged copyright infringement relating to content stored on or made available through the Services.

3. Filing a Takedown Notice

To be effective under 17 U.S.C. § 512(c)(3), your written notice must include substantially the following:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing and information reasonably sufficient to let us locate it (e.g., a URL).
• Your contact information (name, address, telephone number, and email address).
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Please note that under Section 512(f), you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that material is infringing.

4. Counter-Notification

If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Agent that includes:

• Your physical or electronic signature.
• Identification of the material that was removed and the location where it appeared before removal.
• A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the US, any judicial district in which FoundHex may be found), and that you will accept service of process from the complaining party.

5. Repeat Infringers

We will, in appropriate circumstances, suspend or terminate the accounts of users who are determined to be repeat infringers.
